Welcome to Gritta

These Terms of Service (“Terms”) govern your access to and use of Gritta’s website (www.gritta.xyz), services, and platform (collectively, the “Service”). By accessing or using Gritta, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use our Service.

3. Account Registration

Creating an Account

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use at Support@gritta.xyz

Account Security

• Choose a strong, unique password
• Do not share your account credentials with others
• We are not liable for losses resulting from unauthorized account access due to your failure to maintain security

4. User Content

Your Content

You retain ownership of all content you post, upload, or share on Gritta (“User Content”), including:

• Posts, articles, and blog entries
• Comments and discussions
• Photos, videos, and audio files
• Music, artwork, and creative works
• Cryptocurrency wallet addresses and transaction data you choose to share

License to Gritta

By posting User Content, you grant Gritta a worldwide, non-exclusive, royalty-free, transferable license to:

• Use, reproduce, distribute, and display your content on our platform
• Modify and adapt content for technical purposes (formatting, compression, etc.)
• Promote Gritta and your content across our platform and marketing channels

This license ends when you delete your content or account, except where content has been shared by others or is required for legal retention.

Content Standards

You agree NOT to post content that:

• Is illegal, fraudulent, defamatory, or misleading
• Infringes on intellectual property rights, copyrights, or trademarks
• Contains malware, viruses, or harmful code
• Promotes violence, hatred, harassment, or discrimination
• Exploits or harms minors in any way
• Contains unauthorized private information of others
• Impersonates any person or entity
• Constitutes spam, phishing, or unsolicited advertising
• Violates any applicable laws or regulations

5. Cryptocurrency and Blockchain Features

Crypto Activities

Gritta may offer features related to cryptocurrency, blockchain, NFTs, and Web3 technologies. By using these features, you acknowledge:

• Risk: Cryptocurrency transactions are irreversible and subject to significant volatility and risk
• No Financial Advice: Gritta does not provide financial, investment, or legal advice
• Your Responsibility: You are solely responsible for your crypto transactions and wallet security
• Third-Party Services: Crypto features may rely on third-party wallet providers and blockchain networks
• Compliance: You are responsible for complying with tax and regulatory requirements in your jurisdiction

No Liability for Crypto Losses

Gritta is not responsible for:

• Loss of cryptocurrency due to user error, wallet compromise, or market fluctuations
• Failed transactions, network congestion, or blockchain issues
• Third-party wallet or exchange failures

6. Intellectual Property

Gritta’s Property

All content, features, and functionality on Gritta (excluding User Content) are owned by Gritta and protected by copyright, trademark, and other intellectual property laws. This includes:

• The Gritta name, logo, and branding
• Platform design, layout, and interface
• Original articles, graphics, and content created by Gritta

You may not copy, modify, distribute, or create derivative works without our express written permission.

Copyright Infringement

We respect intellectual property rights. If you believe content on Gritta infringes your copyright, contact us at Support@gritta.xyz with:

• Description of the copyrighted work
• Location of the infringing content on our platform
• Your contact information
• A statement of good faith belief that use is unauthorized
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

7. Prohibited Conduct

You agree NOT to:

• Violate any laws or regulations
• Harass, threaten, or abuse other users
• Use Gritta for illegal activities, including money laundering or fraud
• Manipulate or game platform features (vote brigading, fake accounts, etc.)
• Scrape, crawl, or use automated tools to access Gritta without permission
• Reverse engineer or attempt to access our source code
• Interfere with or disrupt the Service or servers
• Collect user information without consent
• Engage in market manipulation or pump-and-dump schemes related to crypto
• Create multiple accounts to evade bans or restrictions

8. Content Moderation

Gritta reserves the right to:

• Remove or refuse to post any User Content
• Suspend or terminate accounts that violate these Terms
• Investigate violations and cooperate with law enforcement
• Modify or discontinue features at any time

We are not obligated to monitor all content but may do so to enforce these Terms and maintain platform safety.

9. Third-Party Services and Links

Gritta may contain links to third-party websites, services, blockchain networks, or crypto platforms. We are not responsible for:

• The content, accuracy, or practices of third-party sites
• Transactions or interactions with third parties
• Security or privacy of third-party services

Your use of third-party services is at your own risk and subject to their terms and policies.

10. Disclaimers

Service Provided “As Is”

Gritta is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of uninterrupted or error-free service
• Warranties of accuracy, reliability, or completeness of content
• Warranties regarding cryptocurrency values or investment returns

No Professional Advice

Content on Gritta is for informational and entertainment purposes only. It does not constitute:

• Financial, investment, or legal advice
• Professional recommendations for crypto investments
• Tax guidance or regulatory compliance advice

Always consult qualified professionals for specific advice.

11. Limitation of Liability

To the maximum extent permitted by law, Gritta and its officers, directors, employees, and agents shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or cryptocurrency
• Damages resulting from your use or inability to use the Service
• Damages from unauthorized access to your account or data
• Damages from user content or third-party conduct
• Damages from cryptocurrency volatility or transaction failures

Our total liability shall not exceed the greater of $100 or the amount you paid to Gritta in the past 12 months.

12. Indemnification

You agree to indemnify, defend, and hold harmless Gritta and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party
• Your crypto transactions or activities on the platform

13. Termination

By You

You may delete your account at any time by contacting Support@gritta.xyz or using account settings.

By Gritta

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your conduct harms other users or Gritta’s reputation
• Required by law or legal process

Upon termination:

• Your right to use Gritta ceases immediately
• We may delete your account and User Content
• Sections of these Terms that should survive termination will remain in effect

14. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Minnesota and the United States, without regard to conflict of law principles.

Informal Resolution

Before filing any legal claim, you agree to first contact us at Support@gritta.xyz to attempt to resolve the dispute informally.

Arbitration Agreement

Any disputes arising from these Terms or your use of Gritta shall be resolved through binding arbitration in accordance with the American Arbitration Association’s rules, rather than in court, except:

• Small claims court disputes
• Intellectual property disputes
• Injunctive or equitable relief

Arbitration will take place in St. Paul, Minnesota, unless otherwise agreed.

Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative proceedings.

15. Changes to These Terms

We may modify these Terms at any time. Changes will be effective when posted with a new “Last Updated” date. Significant changes will be communicated via:

• Email notification to your registered address
• Prominent notice on the platform
• In-app notification

Your continued use of Gritta after changes constitutes acceptance of the updated Terms.

16. General Provisions

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Gritta.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment

You may not assign or transfer these Terms. Gritta may assign its rights and obligations without restriction.

Force Majeure

Gritta is not liable for failures or delays due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or blockchain network failures.
